New HOA Law in effect Jan. 1, 2015

Reported by the Arizona Republic: “Homeowners associations that form after 2014 will not be able to dictate parking rules on public streets within their neighborhoods, a practice enjoyed by current HOAs,”  this according to a new law recently signed by Governor Brewer on April 11, 2013.

Nancy Barto introduced Senate Bill 1278 that  was passed in the legislature on April 8, 2013.

The new Statute reads:

ARS 33-1818. Community authority over public roadways;  applicability

A. Notwithstanding any provision in the community docume nts, after the period of declarant control, an association has no authority over and shall not regulate any roadway for which the ownership has been dedicated to or is otherwise held by a governmental entity.

B. This section applies only to those planned communities for which the declaration is recorded after December 31, 2014.
